The General Contracting Conditions regulate the distance selling relationship between WiPass Technology, S.L. and the user or customer, in accordance with the legal stipulations, in particular, the Law 7/1998, of April 13, on General Contracting Conditions, the General Law for the Defense of Consumers and Users and other complementary laws approved by the Royal Legislative Decree 1/2007, of November 16, the Law 3/2014, of March 27, which modifies the revised text of the General Law for the Defense of Consumers and Users, Law 7/1996, of January 15, 1996 on the Regulation of Retail Trade, Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (RGPD), on the Protection of Personal Data, Organic Law 3/2018, of December 5, 2018, on the Protection of Personal Data and Guarantee of Digital Rights (LOPD-GDD) and Law 34/2002 of July 11, 2002, on Information Society Services and Electronic Commerce.

WiPass Technology, S.L. reserves the right to make the modifications it considers appropriate, without previous notice, in the General Conditions. Such modifications may be made, through its websites, by any means admissible by law and shall be binding during the time they are published on the website and until they are not validly modified by subsequent ones. However, WiPass Technology, S.L. reserves the right to apply, in certain cases, Particular Contracting Conditions with preference to the present General Conditions when it considers it appropriate, announcing them in due time and form.

The purpose of the website is the promotion, information, marketing and sale of WiPass products.

The duration of the contract shall be linked to the delivery of the product without prejudice to the right of withdrawal.

You may also subscribe to the newsletter to receive offers of the referred products or general information that may be of interest to you.

As a user or customer, you expressly declare that you know, understand and accept the terms of use and these general terms and conditions. Likewise, he/she declares to be of legal age and to have the necessary legal capacity to access WiPass Technology, S.L. websites and to contract through them.

To purchase our products, you can go to the corresponding section of our online store.

It is not a prerequisite to register as a user of the web to make the purchase online, although there is this possibility to access our online store. You can access the corresponding section for registration on the website. In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (RGPD), on the Protection of Personal Data, the Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPD-GDD), WiPass Technology, S.L. informs the users that the personal data collected during the registration process and subsequent purchase, will be introduced in a treatment system under its responsibility, with the purpose of processing such actions by the user and managing subsequent actions derived from the same. Unless you inform us otherwise, we will assume that your data has not been modified, that you agree to notify us of any change and that we have your consent to use it in order to maintain the relationship between the parties.

During the purchase process you must identify yourself with the user name and password provided. This data will not be made public. You are responsible for treating confidentially and responsibly the identity and password obtained in the registration as a customer, not being able to transfer them to another.

You can modify the registered information at any time, in your customer area. In this same section you will have access to a history of your orders, this is only a consultation section but its management is allowed, and the user can delete those records that he/she considers it is not necessary to visualize.

Once the purchase process is completed, the customer will receive a confirmation of the purchase by e-mail. It is essential that during the purchase process the user indicates a valid email address. All web content is in English and Spanish.

The customer, upon payment, will receive an invoice telematically.

Offer and validity.

In the case of a product on offer, the offer price and the validity of the offer shall always be indicated together with its essential characteristics.

In compliance with the current regulations WiPass Technology, S.L. offers information about all the articles on sale, their characteristics and prices. Nevertheless, WiPass Technology, S.L. reserves the right to withdraw, replace or change the products offered through its web page, by simply changing its content. In this way, the products offered at all times by the website will be governed by the General Terms and Conditions in force in each case. Likewise, the company shall have the right to stop offering, without prior notice and at any time, access to the aforementioned products.

Essential characteristics of the products.

The products offered in our online store, incorporate a photograph and the essential characteristics of the product. The color of the product, observable in the photograph, is not binding. It is identified in the characteristics.

Warranties.

All products offered on the website enjoy the commercial guarantee of the supplier of the product. WiPass Technology, S.L. has an after-sales service, while the warranty is in force, the customer can execute it by contacting WiPass Technology, S.L. establishment, the after-sales service, by e-mail to hello@wipass.io or to the points established by the supplier itself. Prices

All products indicate the selling price in Euros and include Value Added Tax (VAT). If any other tax is applicable, this would be indicated.

Delivery and transportation costs.

WiPass Technology, S.L. ships in Peninsula, Balearic Islands, Canary Islands, Europe and the Rest of the World.

For deliveries within the Spanish national territory, no delivery costs will be charged.

For deliveries outside Spain, a shipping and handling fee of 8.99 euros will be charged.

Methods of payment and execution of the order.

The customer will be able to pay the amount of his order by choosing any of the following ways. During the purchase process you will have to indicate your choice:

• Bank transfer.

When selecting the bank transfer you will receive, together with the confirmation of your order, an e-mail with WiPass Technology, S.L. bank details.

It is very important that when making the transfer you indicate in the subject line the order number, as well as your name and surname, and make the transfer within 3 days after the order confirmation date in order to validate the order.

If you wish, you can send us the proof of the transfer by e-mail hello@wipass.io. But in any case, the order will not be considered effective until our administration department does not have bank confirmation of the transfer.

We remind you that payment must be made in Euros and that any exchange and bank charges are your responsibility.

In the case of bank transfers made from outside Spain, it is very important that when ordering the transfer, you always inform your bank to take charge of the commissions at origin, those bank commissions and expenses corresponding to your entity. Otherwise, WiPass Technology, S.L. could stop the shipment of your order if we do not receive the full amount of your order.

Any exchange and banking fees are to be paid by the customer.

• Stripe.

Stripe is a technology company. Its software allows individuals and businesses to receive payments over the Internet. Stripe provides the technical, banking and fraud prevention infrastructure required to manage online payment systems. Stripe processes payment data. Delivery of the order.

WiPass Technology, S.L. commits to deliver the order in a maximum of 7 days, from the day following the date on which the payment of the order is confirmed.

Order availability.

The availability of the products offered by WiPass Technology, S.L. may vary according to the customers’ demand. Although WiPass Technology, S.L. updates the stock periodically, the product requested by the customer could be out of stock at that moment. In case of non-execution due to unavailability, WiPass Technology, S.L. will notify the client by e-mail as soon as WiPass Technology, S.L. becomes aware of this situation. The period of this communication shall in no case exceed a maximum period of 30 days. If the order is not fulfilled within the stipulated 30-day period, the customer may request a refund. The aforementioned reimbursement will be made within a maximum period of 14 days.

Right of withdrawal, returns and complaints.

The purchaser shall have a minimum period of fourteen calendar days to cancel, starting from the day the customer receives the product, without any penalty and without any indication of the reasons.

The exercise of the right of withdrawal must be notified by telephone (tel customer service), by sending an e-mail to hello@wipass.io, or by sending your letter to our postal address C/ Ernest Lluch, 32 1º Desp. 1.08 -08302- Mataró, or through the withdrawal form.

According to the provisions of Article 103 of Law 3/2014, of March 27, which amends the revised text of the General Law for the Defense of Consumers and Users, supplies of services or goods made according to consumer specifications or clearly personalized, or which, by their nature, cannot be returned or may deteriorate or expire rapidly, are exempt from withdrawal.

• The return of the product due to withdrawal.

The customer must return or deliver the product directly to WiPass Technology, S.L., to the address C/ Ernest Lluch, 32 1º Desp. 1.08 -08302- Mataró, without any undue delay, and in any case within a maximum period of fourteen calendar days from the date on which the right of withdrawal from the contract is formalized. The term shall be deemed to have been met if the customer returns the product before the end of the term.

• The customer shall bear the cost of returning the product.

In any case, the products to be returned must be in perfect condition, unused and in their original packaging. Therefore, please make sure that the package is properly protected and sealed to avoid transportation problems. Once received, we will check its status. As soon as we verify that the item(s), as well as any components, accessories, promotional gifts and documentation, are complete and in perfect condition, we will proceed to refund the money paid.

• Return of the defective product.

In case the product is not in good condition and the causes are not attributable to the customer, the customer will have the right to return the product, informing WiPass Technology, S.L. the reason for the return through any of the means provided in the present contracting conditions, and without any cost for the customer. This return due to defect or poor condition of the product will not be considered a right of withdrawal.

WiPass Technology, S.L. is committed to assume the cost of the return and to return the product for a new one according to the conditions accepted at the moment of the sale.

• Refund of payment.

The reimbursement of the amounts received from the customer will be made using the same means of payment used by the customer, unless otherwise provided. WiPass Technology, S.L. will be able to retain the reimbursement until having received the product, reason for withdrawal, or until the customer provides proof of return of the product, depending on which condition is fulfilled first.

WiPass Technology, S.L. will make the reimbursement in a maximum period of 14 days, counting from the reception of the product.

Jurisdiction.

Likewise, WiPass Technology, S.L. reserves the right to file the civil or penal actions it considers appropriate for the improper use of its website and contents or for the non-fulfillment of the present conditions.

The relationship between the user and the provider shall be governed by the regulations in force and applicable in the Spanish territory. Should any controversy arise, the parties may submit their disputes to arbitration or resort to ordinary jurisdiction in compliance with the rules on jurisdiction and competence in this regard.
